a. Definitions. This contract is for the hire of musical instruments and accessories (“equipment”) and the parties to this contract are:
(i) The “Hirer” – being the individual named on the order form who agrees to these Terms & Conditions.
(ii) HireItCo LTD (Company No. 10603316)

General

a. Definitions. This contract is for the hire of musical instruments and accessories (“equipment”) and the parties to this contract are:
(i) The “Hirer” – being the individual named on the order form who agrees to these Terms & Conditions.
(ii) HireItCo LTD (Company No. 10603316), trading as Musical Instrument Hire Co, Registered office: Unit 9, Hall Farm, Holwell, Melton Mowbray, LE14 4SZ.

b. Extent of Contract. This agreement is not assignable and becomes binding once HireItCo LTD confirms the Hirer’s order.

c. Commencement of Hire. The hire begins when the equipment is collected by the Hirer or delivered to the address specified on the order form.

d. End of Hire. The hire ends when the equipment is received back by HireItCo LTD.

e. Termination. HireItCo LTD reserves the right to terminate the hire and recover equipment at any time if the Hirer breaches the terms of this contract, or if insolvency proceedings affect the Hirer. Any monies owed up to the point of termination remain payable.

f. Ownership. All equipment remains the sole property of HireItCo LTD. No transfer of ownership is implied or granted under this hire agreement.


Charges

a. Hire Fees. Hire fees are payable monthly in advance (or as otherwise agreed for short-term or event hire). Additional fees may apply if the terms of the hire change.

b. Transport Costs. Delivery and collection charges are separate from hire fees. HireItCo LTD is not responsible for delays caused by third-party couriers.

c. Payment. All hire charges must be paid before collection or delivery.

d. Loss or Non-Return. Equipment not returned at the end of the hire will be treated as lost. A charge equal to the full replacement value will become payable.

e. Outstanding Payments. All unpaid hire charges and reasonable recovery costs are payable by the Hirer.

f. Non-Payment. Where hire payments are not made, the equipment must be returned within 30 days. Failure to return equipment within this period will result in a charge equal to the full retail replacement value.

g. Late Return (short-term/event hire). If equipment is not returned after the agreed period, a grace period of one week will apply. Thereafter, a daily charge of £15 will apply until the equipment is returned or the replacement value is paid in full.

h. Card Charges. Any additional fees will be charged automatically to the Hirer’s card.

i. Packaging. If the original box is not available for return, a replacement packaging and handling charge of £12.95 will be applied.


Hirer’s Responsibilities

a. Receipt of Equipment. All deliveries require a signature. Missing or faulty items must be reported immediately on receipt. Unreported items are the Hirer’s responsibility.

b. Insurance. Equipment is insured by HireItCo LTD. In the event of loss or theft, an insurance excess (equal to the deposit) will apply. All incidents must be reported to the Police, with a crime reference number supplied. Failure to obtain a crime reference number will result in the Hirer being liable for the full replacement cost.

c. Care of Equipment. The Hirer is responsible for safe and proper use of equipment. Any damage, faults, or defects occurring during hire must be reported promptly.

d. Irreparable Loss/Damage. Where equipment is damaged beyond repair, lost, or stolen (with valid crime reference), an insurance excess of £95 will be charged.

e. Packaging. Original packaging must be kept for return. Replacement packaging charges apply where discarded.


Company Responsibilities

a. Inspection. All equipment is checked before dispatch. If equipment develops a fault during normal use, HireItCo LTD will, where possible, provide a replacement.

b. Transport. HireItCo LTD will make reasonable efforts to deliver and collect equipment on time but cannot be held responsible for courier delays or other circumstances beyond control.

c. Liability. HireItCo LTD is not liable for indirect or consequential losses, including financial loss, arising from late delivery, non-delivery, breakdown, or repossession.

d. Accessories. Accessories (e.g. bows, strings, drumsticks, tuners) are not covered under the replacement service.
